Acceptance of terms

These Terms of Service ("Terms") are a binding agreement between you and DeliveryDish LLC ("DeliverDish," "we," "us"), the operator of the DeliverDish application and website (the "Service"). By creating an account, checking a box indicating acceptance, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. These Terms are effective as of July 3, 2026.

What DeliverDish does

DeliverDish generates AI-assisted meal plans and shopping lists and can match ingredients to Kroger products near you. Meal plans, nutrition and calorie estimates, ingredient lists, and product/price matches are generated automatically by third-party AI and data providers and may be inaccurate, incomplete, or out of date.

Eligibility & age

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian. The Service is not directed to and may not be used by children under 13. Where your local law requires a higher minimum age for consent to data processing, you must meet that age.

Not health, medical, or dietary advice

The Service does not provide medical, nutritional, or dietary advice and is not a substitute for professional guidance. Calorie targets and macros are estimates only. Always verify every ingredient for allergens and suitability before purchasing, preparing, or serving food — especially where food allergies, intolerances, pregnancy, or medical conditions are involved. A food allergy can be life-threatening; do not rely on the Service to identify or exclude allergens. Consult a qualified healthcare professional before making dietary changes.

Your account

You are responsible for keeping your login credentials secure and for all activity under your account. You must provide accurate information and promptly update it as needed. Notify us if you suspect unauthorized use of your account.

Acceptable use

You agree not to: misuse the Service; access it in unauthorized ways; scrape, cache, or resell data (including Kroger pricing) except as the Service intends; overload, disrupt, or reverse-engineer our systems; or use the Service to violate any law or third-party rights. We may suspend or terminate accounts that abuse the Service or our partners’ APIs.

Third-party services

The Service relies on third parties, including Kroger (product, pricing, and cart features), our AI provider, authentication and hosting providers, and an email provider. Grocery pricing and availability are provided through Kroger and are subject to Kroger’s own terms; prices shown are estimates and may not match in-store or pickup pricing. We are not responsible for third-party services, their content, pricing, or availability.

Intellectual property

The Service, including its software, design, and the "DeliverDish" name and logo, is owned by DeliveryDish LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use. You retain the content you create (such as saved plans and lists) and grant us a license to host and process it to operate the Service.

Pricing

DeliverDish is currently free to use. If this changes, we will update these Terms and give notice before any charges apply to you.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF MEAL PLANS, NUTRITION ESTIMATES, INGREDIENT INFORMATION, OR PRICING. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELIVERDISH AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM FOOD PURCHASED, PREPARED, OR CONSUMED, OR FROM RELIANCE ON ANY AI-GENERATED CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

Indemnification

You agree to indemnify and hold harmless DeliverDish and its owners from any claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Subject to the arbitration section below, the exclusive venue for any dispute not subject to arbitration is the state and federal courts located in Florida.

Dispute resolution & binding arbitration

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. You and DeliverDish agree that any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, rather than in court, except that either party may bring qualifying claims in small-claims court. Arbitration will be conducted on an individual basis only. YOU AND DELIVERDISH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You may opt out of this arbitration agreement by emailing support@trydeliverdish.com within 30 days of first accepting these Terms; opting out does not affect the other provisions. Where mandatory local law prohibits binding arbitration, this section does not apply to you.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution) will survive.

Changes to the Service and Terms

We may modify or discontinue features, and we may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, in the app). Continued use after changes take effect constitutes acceptance of the updated Terms.

Severability & entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements.
